To download the Mobile Application, visit www.nbclosangeles.com/mobile or the application store on your mobile device and follow the provided instructions to download the free NBCLA App. Then, open the Mobile Application, click on the tile labeled “The Challenge”, and follow the provided instructions to complete and thereafter submit the entry form. The game has been optimized for several mobile, desktop and tablet devices. If you are using an older version of an android browser or a phone, tablet or desktop browser that is not supported, you can also play the game by going directly to www.nbcla.com/challenge from your desktop using Google Chrome version 45 or newer. For any technical issues please contact support@digitaljoy.media. If you choose to submit your Entry via your web-enabled mobile device, data rates may apply. See your wireless service provider for details on rates and capabilities. All Entries become the property of Sponsors and will not be acknowledged.
After completing Registration as described above, you may enter the Promotion during any and all episodes of the Show throughout the Promotion Period (see Weekly Show Dates below), either by visiting the Website or Mobile Application, logging in with your selected username and password, and submitting answers to multiple-choice questions (“Entry”). There will be a different set of three (3) multiple choice questions per Show.
The Promotion will consist of a total of fifty-four (54) individual random drawings (each an “Individual Sweepstakes Drawing”). Each Show runs approximately thirty (30) minutes.
Individual Sweepstakes Drawing:
There will be three (3) Individual Sweepstakes Drawings during each episode of the Show throughout the Promotion Period (see Weekly Show Dates below). During each Show, three (3) questions will appear in the Show (exact timing to be determined by Sponsors in their sole discretion). During each Show, the first question will be revealed at the end of segment one (1) of the Show. Entrants must answer the first question (correctly or incorrectly) before the end of the first commercial in the Show’s first commercial break to become eligible for the first Individual Sweepstakes Drawing of the corresponding Show. You do not have to answer the question correctly to be eligible for the corresponding Individual Sweepstakes Drawing and your answer to the question will not affect your chances of winning an Individual Sweepstakes Drawing. The first Individual Sweepstakes Drawing will take place during the first commercial break.
The second question will be revealed at the end of segment three (3) of the Show. Those who answer the second question (correctly or incorrectly) before the end of the first commercial in the Show’s third commercial break will be eligible for the second Individual Sweepstakes Drawing of the corresponding Show. You do not have to answer the question correctly to be eligible for the corresponding Individual Sweepstakes Drawing and your answer to the question will not affect your chances of winning an Individual Sweepstakes Drawing. The second Individual Sweepstakes Drawing will take place during the third commercial break.
The third question will be revealed at the end of segment four (4) of the Show. Those who answer the third question (correctly or incorrectly) before the end of the first commercial in the Show’s fourth commercial break will be eligible for the third Individual Sweepstakes Drawing of the corresponding Show. The third Individual Sweepstakes Drawing will take place during the fourth commercial break. You do not have to answer the question correctly to be eligible for the corresponding Individual Sweepstakes Drawing and your answer to the question will not affect your chances of winning an Individual Sweepstakes Drawing. Answers to questions received after the end of the first commercial in the Show’s fourth commercial break will be ineligible.
Answers to a question must be received before the end of the first commercial of each corresponding commercial break to be eligible for the corresponding Individual Sweepstakes Drawing.

Limit one (1) Entry per person per Individual Sweepstakes Drawing, for a maximum of fifty-four (54) Entries per person throughout the Promotion Period, regardless of method of Entry. Multiple entries received from any person or email address beyond this limit will void all such additional entries. Entries must be received before completion of the January 5, 2025 Show to be eligible for the Individual Sweepstakes Drawings regardless of method of Entry. Entries generated by a script, macro, or other automated means will be disqualified. Entries that are incomplete, garbled, corrupted, or unintelligible for any reason including, but not limited to, computer or network malfunction or congestion (including at Sponsors and other entities), are void and will not be accepted. Entry constitutes permission (except where prohibited by law) to use entrant's name, city, state, likeness, image, and/or voice for purposes of advertising, promotion, and publicity in any and all media, now or hereafter known throughout the world in perpetuity without additional compensation, notification or approval.
Television Transmission Delays: Depending on the entrant's television service (i.e., cable, digital cable, over-the-air via antenna, streaming service, or satellite), the reception of the transmission of the Show may reach particular households at different times. If entrants have a digital video recorder (DVR) hooked up to their televisions, they may experience a delay in receiving the transmission as well. Sponsors disclaim any liability and will make no allowance for delays in receiving the transmission of the Show.
How to Play Using a Mobile Communications Enabled Device: three (3) multiple-choice questions will appear during each Show, as specified in Section 3 above. Entrants should submit their answer for each individual question using the question number and the letter of their answer (a, b, or c) on the NBCLA Mobile Application. Point accumulation will not be a factor in each Individual Sweepstake Drawing but participation and the questions answered will reflect which prizes the Entrant is eligible to win (see “Prize” section below for more information).
You must have a mobile communications subscription with a participating carrier or otherwise have access to a mobile communications network. In addition, you must provide all equipment and software necessary to connect to the communication network, including, but not limited to, a mobile handset or other mobile access device that is in working order. In the event of a dispute as to the identity of a mobile application entrant, the authorized account holder of the mobile telephone number used to enter will be deemed to be the entrant. The "Authorized Account Holder" of a mobile telephone number is defined as the natural person who is assigned the mobile telephone number by the wireless carrier as shown on the carrier's records. The potential winner may be required to show proof of being the Authorized Account Holder.
Mobile Device Delays: Entries via Mobile Application may be subject to delays resulting from carrier congestion or network dropouts. Due to differences in times between servers, all mobile Entries will be time-stamped according to the timestamp on Sponsors' server. Sponsors disclaim any liability and will make no allowance for delays in a message arriving at Sponsors' server.
How to Play Online: three (3) multiple-choice questions will appear during each Show, as specified in Section 3 above. Entrants may answer the questions online at http://www.nbcla.com/challenge. Entrants should "click" on the appropriate answer letter, represented by large boxes with A, B, or C on them. After every question, the page will refresh with the next set of selections. Point accumulation will not be a factor in each Individual Sweepstakes Drawing but participation and number of questions answered may reflect which prizes the Entrant is eligible to win (see “Prize” section below for more information).
In the event of a dispute as to the identity of any online entrant, Sponsors reserve the right to deem the authorized account holder of the email address used to enter as the entrant. The "Authorized Account Holder" of an email address is the natural person assigned an email address by an Internet access provider, online service provider, or other organization responsible for assigning email addresses for the domain associated with the submitted address or the natural person assigned as the account holder. The potential winner may be required to show proof of being the Authorized Account Holder.
Sweepstakes Winners: Starting with the Show on September 8, 2024, representatives of Sponsors will randomly select a total of three (3) winners (“Winners”, each a “Winner”) during each Show. Winner announcements will correspond to each Individual Sweepstakes Drawing. There will be a total of fifty-four (54) potential Winners selected throughout the Promotion Period. Winners will be randomly selected and announced as follows:
Universal Studios Hollywood Winner: There will be one (1) potential Universal Studios Hollywood winner (“Universal Winner”, collectively, the “Universal Winners”) at the end of each Show. Entrants who answer the first question (correctly or incorrectly) during the corresponding Show, as further provided in Section 3 above, are eligible to become potential Universal Winners. Potential Universal Winners will be announced during the second (2) segment of each week’s Show and will be notified via phone and/or email the following business day. Sponsors reserve the right to change the corresponding prize at their discretion without prior notice.
Pechanga Winner: There will be one (1) potential Pechanga winner (“Pechanga Winner”, collectively, the “Pechanga Winners”) at the end of each Show.. Entrants who answer the second question (correctly or incorrectly) during the corresponding Show, as further provided in Section 3 above, are eligible to become potential Pechanga Winners. Potential Pechanga Winners will be announced during the fourth (4) segment of the respective week’s Show and will be notified via phone and/or email the following business day. Sponsors reserve the right to change the corresponding prize at their discretion without prior notice.
Chargers Tickets Winner: There will be one (1) potential Chargers Tickets winner (“Chargers Tickets Winner”, collectively, the “Chargers Tickets Winners”) at the end of each Show on September 8, September 29, October 13, October 27, November 17 and December 1, 2024. Entrants who answer the third question (correctly or incorrectly) during the corresponding Show, as further provided in Section 3 above, are eligible to become potential Chargers Tickets Winners. Potential Chargers Tickets Winners will be announced during the fifth (5) segment of the respective week’s Show and will be notified via phone and/or email the following business day. Sponsors reserve the right to change the corresponding prize at their discretion without prior notice.
Barry’s Tickets Winner: There will be one (1) potential Barry’s Tickets winner (“Barry’s Tickets Winner”, collectively, the “Barry’s Tickets Winners”) at the end of each Show on September 15, September 22, October 6, October 20, November 3, November 10, November 24, December 8, December 15, December 22, December 29, 2024 and January 5, 2025. Entrants who answer the third (3) question (correctly or incorrectly) during the corresponding Show, as further provided in Section 3 above, are eligible to become potential Barry’s Tickets Winners. Potential Barry’s Tickets Winners will be announced during the fifth (5) segment of each week’s Show and will be notified via phone and/or email the following business day. Sponsors reserve the right to change the corresponding prize at their discretion without prior notice.
Universal Studios Winner, Pechanga Winner, Chargers Tickets Winner, Barry’s Tickets Winner, Verse Winner may be referred to herein as “Winner” or collectively, “Winners”.
Sponsors will make two (2) attempts to notify potential Winners via phone and/or email address submitted at the time of Entry. Sponsors may share potential Winners’ names and contact information with Promotion Entities and/or Prize Provider, as applicable, if necessary. Data compilation may be subject to carrier delays and other technical issues beyond Sponsors' control. Potential Winners may each be required to sign and return to Sponsors within ten (10) days of the date of attempted notice, an affidavit of eligibility, release of liability, and, except where prohibited, publicity release (collectively, "Promotion Documents"). Noncompliance within this time period will result in disqualification, and, at Sponsors’ sole discretion, an alternate potential Winner may be selected from the remaining eligible Entries. If any potential Winner cannot be reached, is found to be ineligible, cannot or does not comply with these Official Rules, or if Prize (as defined below) or Prize notification is returned as undeliverable, such potential Winner will be disqualified and time permitting, at Sponsors' sole discretion, an alternate potential Winner may be selected from the remaining eligible Entries.
In the event this Promotion is terminated before all Prizes are awarded, all remaining Prizes will be forfeited. In the event that a Prize element is not available for any reason, the remaining elements of Prize shall constitute full satisfaction of Sponsors' Prize obligation to Winner and no additional compensation will be awarded. All elements of Prizes must be redeemed at the same time.
Limit one (1) Prize per person, family, or household per season. Prizes are subject to change from week to week and without prior notice, in Sponsor’s sole discretion.
Chargers Tickets Package, Pechanga Package, Barry’s Tickets Package, or USH Tickets Package may be referred to herein as “Prize” or collectively “Prizes”.
Chargers Tickets Event may be referred to herein as “Event” or “Events”.
Sponsors will determine all details of Prizes in their sole discretion. Total ERV of all Chargers Tickets Packages is eight thousand four hundred dollars ($8,400); total ERV of all Pechanga Packages is nine thousand eight hundred and eighty-two dollars ($9,882); total ERV of all USH Tickets Packages is four thousand six hundred forty-four dollars ($4,644); and total ERV of all Barry’s Tickets Packages is nine thousand dollars ($9,000). Total ERV of all Prizes is thirty-one thousand nine hundred and twenty-six dollars ($31,926). Actual Retail Value (“ARV”) of Prizes may vary. Any difference between ERV and ARV will not be awarded. Sponsors will determine all details of Prizes in their sole discretion. For any Prize with a fair market value (“FMV”) of six hundred dollars ($600) or greater, Sponsors will furnish an Internal Revenue Service Form 1099 to Winner for the FMV of Prize for the year in which Prize was made available to Winner. All details of Prize will be determined in Sponsors' sole discretion.
Sponsors reserve the right to substitute Prize (or portion thereof) with a similar prize (or prize element) of comparable or greater value. All taxes and other expenses, costs, or fees associated with the acceptance and/or use of Prize are the sole responsibility of Winner. Prize cannot be transferred by Winner or redeemed for cash and is valid only for the items detailed above, with substitution of Prize by Winner. If Prize is unclaimed within a reasonable time after notification from Sponsors, as determined in Sponsors' sole discretion, it will be forfeited, and time permitting, an alternate Winner may be selected from the remaining eligible Entries at Sponsors' sole discretion.
Each Winner must be able to attend Event that corresponds to his/her Prize, or Prize will be forfeited. Sponsors shall have no responsibility or liability for cancellations, delays, or any other change by any company or person providing any element of Prize due to reasons beyond Sponsors’ control and are not responsible or liable for any expenses incurred as a consequence thereof. Date and/or time of Event is subject to change. Event is subject to cancellation. Winner and/or Guest, if any, must comply with all applicable venue rules and regulations in connection with Prize.
All parts of the Prize are subject to availability, and subject to change or cancellation without written notice or warning. Should an act of God, hurricane, war, fire, riot, earthquake, act of public enemies, actions of governmental authorities, epidemics, pandemics and the spread of infectious diseases, including without limitation COVID-19 (as defined by the World Health Organization and any of the strains, variants or mutations thereof), and any related governmental or judicial actions, including but not limited to travel restrictions, taken in connection with, or as a response to, any such event, or any other event beyond the reasonable control of a party, whether or not existing, known, foreseen or foreseeable at the time this Promotion occurs, render the redemption or fulfillment of all or a portion of the Prize delayed, hindered, adversely affected, impracticable, or impossible, Sponsors and Prize Provider in their sole and absolute discretion, reserve the right to evaluate, make modifications to, and restructure the redemption and fulfillment processes and timelines for the Prize, or portion thereof, that Sponsors and Prize Provider are responsible for, which may include, but is not limited to, providing additional time for redemption and/or fulfillment. Sponsors and Prize Providers may modify and/or restructure the Prize or portions thereof to comply with government orders or guidelines and Sponsors' and/or Prize Provider's health and safety requirements. In addition, Winner and Guest should be aware of and comply with government guidelines regarding travel restrictions and mandatory quarantines before traveling. Should the Prize, or a portion thereof, become unavailable Sponsors and Prize Provider shall make reasonable efforts to provide Winner with substitute experiences and/or items of a similar nature and value for that portion of the Prize that is unavailable. If no substitute prizing is reasonably available then the remaining components, if any, of the Prize shall constitute full satisfaction of Sponsors' and Prize Provider’s Prize obligation to Winner, and no other or additional compensation will be awarded.
Prize fulfillment and related activities will take place on a date and time designated by Sponsors and only when and in a manner that it is safe to do so, as determined in Sponsors' sole discretion in consultation with appropriate health and safety experts. Winner and Guest, if any must follow all instructions given by representatives of Sponsors and/or Prize Provider at all times.
In connection with any visit to Universal Studios Hollywood, or any location in connection with the Prize, please be advised that Sponsors' and/or Universal Studios Hollywood’s policies, CDC guidelines, and the recommendations of health officials must be followed. In addition, Guest should be aware of and comply with government guidelines regarding travel restrictions and mandatory quarantines before visiting Universal Studios Hollywood. Please note that any public location where people are present provides an inherent risk of exposure to COVID-19, and Sponsors and Universal Studios Hollywood cannot guarantee that any person will not be exposed during a visit. By accepting the Prize, Winner, on behalf of him or herself and on behalf of any individuals who use the Prize, expressly assumes the risk that during use of the Prize they may be exposed to COVID-19, the Coronavirus that causes COVID-19, or other communicable and/or infectious diseases. Winner and Guest, if any, expressly understand that these risks include contracting COVID-19 or other communicable and/or infectious diseases and the associated dangers, medical complications and physical and mental injuries, both foreseen and unforeseen, that may result from contracting COVID-19 or other communicable and/or infectious diseases.
If required, Winner and Guest, if any must cooperate with Sponsors' inquiries related to public health matters and follow Sponsors' related rules and processes, including, but not limited to, disclosures or processes recommended or required by public health authorities to protect the health and safety of Winner, Guest, and others. Winner and Guest may be subject to health screenings (which may include, but are not limited to, temperature checks, symptom screening, lab testing, and/or other medical exams) to be conducted by Sponsors, Prize Provider, or their designee(s) prior to or during the fulfillment of the Prize and related activities. Failure to fully comply with Sponsors' requests or requirements may result in forfeiture of the Prize or portions thereof, as determined in Sponsors' discretion.
During a period starting approximately four (4) weeks before participation in activities related to the Prize and ending approximately four (4) weeks after participation in the last of such activities (such period(s) subject to change based on medical guidance, and/or policy guidance), Winner and Guest may be required to inform Sponsors, upon Sponsors' request, about matters relating to communicable illnesses and safe fulfillment of the Prize and related activities, including, without limitation: (a) medical symptoms; (b) travel history; (c) recent contact with others who have displayed symptoms of or have otherwise been confirmed to have a communicable illness; and (d) active public health orders issued by a civil authority or any similar public health mandate (e.g., order to quarantine, order to stay at home, order to disclose communicable illness) to which Winner and/or Guest are subject.
EXCLUDING UNIVERSAL PRIZE CLAIMS, If THE controversy or claim is not otherwise resolved through direct discussions or mediation, it shall THEN be resolved by FINAL AND binding arbitration administered by JUDICIAL ARBITRATION AND MEDIATION SERVICES, INC., in accordance with its Streamlined Arbitration Rules and Procedures or subsequent versions thereof (“JAMS Rules”). The JAMS Rules for selection of an arbitrator shall be followed, except that the arbitrator shall be experienced and licensed to practice law in NEW YORK. All proceedings brought pursuant to this paragraph will be conducted in the County of NEW YORK, NEW YORK. THE REMEDY FOR ANY CLAIM SHALL BE LIMITED TO ACTUAL DAMAGES, AND IN NO EVENT SHALL ANY PARTY BE ENTITLED TO RECOVER PUNITIVE, EXEMPLARY, CONSEQUENTIAL, OR INCIDENTAL DAMAGES, INCLUDING ATTORNEY’S FEES OR OTHER SUCH RELATED COSTS OF BRINGING A CLAIM, OR TO RESCIND THIS AGREEMENT OR SEEK INJUNCTIVE OR ANY OTHER EQUITABLE RELIEF.

Sponsors disclaim any liability and will make no allowance for delays in a message arriving at Sponsors' server.
How to Play Online: three (3) multiple-choice questions will appear during each Show, as specified in Section 3 above. Entrants may answer the questions online at http://www.nbcla.com/challenge. Entrants should "click" on the appropriate answer letter, represented by large boxes with A, B, or C on them. After every question, the page will refresh with the next set of selections. Point accumulation will not be a factor in each Individual Sweepstakes Drawing but participation and number of questions answered may reflect which prizes the Entrant is eligible to win (see “Prize” section below for more information).
In the event of a dispute as to the identity of any online entrant, Sponsors reserve the right to deem the authorized account holder of the email address used to enter as the entrant. The "Authorized Account Holder" of an email address is the natural person assigned an email address by an Internet access provider, online service provider, or other organization responsible for assigning email addresses for the domain associated with the submitted address or the natural person assigned as the account holder. The potential winner may be required to show proof of being the Authorized Account Holder.
Sweepstakes Winners: Starting with the Show on September 8, 2024, representatives of Sponsors will randomly select a total of three (3) winners (“Winners”, each a “Winner”) during each Show. Winner announcements will correspond to each Individual Sweepstakes Drawing. There will be a total of fifty-four (54) potential Winners selected throughout the Promotion Period. Winners will be randomly selected and announced as follows:
Universal Studios Hollywood Winner: There will be one (1) potential Universal Studios Hollywood winner (“Universal Winner”, collectively, the “Universal Winners”) at the end of each Show. Entrants who answer the first question (correctly or incorrectly) during the corresponding Show, as further provided in Section 3 above, are eligible to become potential Universal Winners. Potential Universal Winners will be announced during the second (2) segment of each week’s Show and will be notified via phone and/or email the following business day. Sponsors reserve the right to change the corresponding prize at their discretion without prior notice.
Pechanga Winner: There will be one (1) potential Pechanga winner (“Pechanga Winner”, collectively, the “Pechanga Winners”) at the end of each Show.. Entrants who answer the second question (correctly or incorrectly) during the corresponding Show, as further provided in Section 3 above, are eligible to become potential Pechanga Winners. Potential Pechanga Winners will be announced during the fourth (4) segment of the respective week’s Show and will be notified via phone and/or email the following business day. Chargers Tickets Winner: There will be one (1) potential Chargers Tickets winner (“Chargers Tickets Winner”, collectively, the “Chargers Tickets Winners”) at the end of each Show on September 8, September 29, October 13, October 27, November 17 and December 1, 2024. Entrants who answer the third question (correctly or incorrectly) during the corresponding Show, as further provided in Section 3 above, are eligible to become potential Chargers Tickets Winners. Potential Chargers Tickets Winners will be announced during the fifth (5) segment of the respective week’s Show and will be notified via phone and/or email the following business day. Barry’s Tickets Winner: There will be one (1) potential Barry’s Tickets winner (“Barry’s Tickets Winner”, collectively, the “Barry’s Tickets Winners”) at the end of each Show on September 15, September 22, October 6, October 20, November 3, November 10, November 24, December 8, December 15, December 22, December 29, 2024 and January 5, 2025. Entrants who answer the third (3) question (correctly or incorrectly) during the corresponding Show, as further provided in Section 3 above, are eligible to become potential Barry’s Tickets Winners. Potential Barry’s Tickets Winners will be announced during the fifth (5) segment of each week’s Show and will be notified via phone and/or email the following business day. Sponsors reserve the right to change the corresponding prize at their discretion without prior notice.
Universal Studios Winner, Pechanga Winner, Chargers Tickets Winner, Barry’s Tickets Winner, Verse Winner may be referred to herein as “Winner” or collectively, “Winners”.
Sponsors will make two (2) attempts to notify potential Winners via phone and/or email address submitted at the time of Entry. Sponsors may share potential Winners’ names and contact information with Promotion Entities and/or Prize Provider, as applicable, if necessary. Data compilation may be subject to carrier delays and other technical issues beyond Sponsors' control. Potential Winners may each be required to sign and return to Sponsors within ten (10) days of the date of attempted notice, an affidavit of eligibility, release of liability, and, except where prohibited, publicity release (collectively, "Promotion Documents"). Noncompliance within this time period will result in disqualification, and, at Sponsors’ sole discretion, an alternate potential Winner may be selected from the remaining eligible Entries. If any potential Winner cannot be reached, is found to be ineligible, cannot or does not comply with these Official Rules, or if Prize (as defined below) or Prize notification is returned as undeliverable, such potential Winner will be disqualified and time permitting, at Sponsors' sole discretion, an alternate potential Winner may be selected from the remaining eligible Entries.
In the event this Promotion is terminated before all Prizes are awarded, all remaining Prizes will be forfeited. In the event that a Prize element is not available for any reason, the remaining elements of Prize shall constitute full satisfaction of Sponsors' Prize obligation to Winner and no additional compensation will be awarded. All elements of Prizes must be redeemed at the same time.
Limit one (1) Prize per person, family, or household per season. Prizes are subject to change from week to week and without prior notice, in Sponsor’s sole discretion.
Chargers Tickets Package, Pechanga Package, Barry’s Tickets Package, or USH Tickets Package may be referred to herein as “Prize” or collectively “Prizes”.
Chargers Tickets Event may be referred to herein as “Event” or “Events”.
Sponsors will determine all details of Prizes in their sole discretion. Total ERV of all Chargers Tickets Packages is eight thousand four hundred dollars ($8,400); total ERV of all Pechanga Packages is nine thousand eight hundred and eighty-two dollars ($9,882); total ERV of all USH Tickets Packages is four thousand six hundred forty-four dollars ($4,644); and total ERV of all Barry’s Tickets Packages is nine thousand dollars ($9,000). Total ERV of all Prizes is thirty-one thousand nine hundred and twenty-six dollars ($31,926). Actual Retail Value (“ARV”) of Prizes may vary. Any difference between ERV and ARV will not be awarded. Sponsors will determine all details of Prizes in their sole discretion. For any Prize with a fair market value (“FMV”) of six hundred dollars ($600) or greater, Sponsors will furnish an Internal Revenue Service Form 1099 to Winner for the FMV of Prize for the year in which Prize was made available to Winner. All details of Prize will be determined in Sponsors' sole discretion.
Sponsors reserve the right to substitute Prize (or portion thereof) with a similar prize (or prize element) of comparable or greater value. All taxes and other expenses, costs, or fees associated with the acceptance and/or use of Prize are the sole responsibility of Winner. Prize cannot be transferred by Winner or redeemed for cash and is valid only for the items detailed above, with substitution of Prize by Winner. If Prize is unclaimed within a reasonable time after notification from Sponsors, as determined in Sponsors' sole discretion, it will be forfeited, and time permitting, an alternate Winner may be selected from the remaining eligible Entries at Sponsors' sole discretion.
Each Winner must be able to attend Event that corresponds to his/her Prize, or Prize will be forfeited. Sponsors shall have no responsibility or liability for cancellations, delays, or any other change by any company or person providing any element of Prize due to reasons beyond Sponsors’ control and are not responsible or liable for any expenses incurred as a consequence thereof. Date and/or time of Event is subject to change. Event is subject to cancellation. Winner and/or Guest, if any, must comply with all applicable venue rules and regulations in connection with Prize.
All parts of the Prize are subject to availability, and subject to change or cancellation without written notice or warning. Should an act of God, hurricane, war, fire, riot, earthquake, act of public enemies, actions of governmental authorities, epidemics, pandemics and the spread of infectious diseases, including without limitation COVID-19 (as defined by the World Health Organization and any of the strains, variants or mutations thereof), and any related governmental or judicial actions, including but not limited to travel restrictions, taken in connection with, or as a response to, any such event, or any other event beyond the reasonable control of a party, whether or not existing, known, foreseen or foreseeable at the time this Promotion occurs, render the redemption or fulfillment of all or a portion of the Prize delayed, hindered, adversely affected, impracticable, or impossible, Sponsors and Prize Provider in their sole and absolute discretion, reserve the right to evaluate, make modifications to, and restructure the redemption and fulfillment processes and timelines for the Prize, or portion thereof, that Sponsors and Prize Provider are responsible for, which may include, but is not limited to, providing additional time for redemption and/or fulfillment. Sponsors and Prize Providers may modify and/or restructure the Prize or portions thereof to comply with government orders or guidelines and Sponsors' and/or Prize Provider's health and safety requirements. In addition, Winner and Guest should be aware of and comply with government guidelines regarding travel restrictions and mandatory quarantines before traveling. Should the Prize, or a portion thereof, become unavailable Sponsors and Prize Provider shall make reasonable efforts to provide Winner with substitute experiences and/or items of a similar nature and value for that portion of the Prize that is unavailable. If no substitute prizing is reasonably available then the remaining components, if any, of the Prize shall constitute full satisfaction of Sponsors' and Prize Provider’s Prize obligation to Winner, and no other or additional compensation will be awarded.
Prize fulfillment and related activities will take place on a date and time designated by Sponsors and only when and in a manner that it is safe to do so, as determined in Sponsors' sole discretion in consultation with appropriate health and safety experts. Winner and Guest, if any must follow all instructions given by representatives of Sponsors and/or Prize Provider at all times.
In connection with any visit to Universal Studios Hollywood, or any location in connection with the Prize, please be advised that Sponsors' and/or Universal Studios Hollywood’s policies, CDC guidelines, and the recommendations of health officials must be followed. In addition, Guest should be aware of and comply with government guidelines regarding travel restrictions and mandatory quarantines before visiting Universal Studios Hollywood. Please note that any public location where people are present provides an inherent risk of exposure to COVID-19, and Sponsors and Universal Studios Hollywood cannot guarantee that any person will not be exposed during a visit. By accepting the Prize, Winner, on behalf of him or herself and on behalf of any individuals who use the Prize, expressly assumes the risk that during use of the Prize they may be exposed to COVID-19, the Coronavirus that causes COVID-19, or other communicable and/or infectious diseases. Winner and Guest, if any, expressly understand that these risks include contracting COVID-19 or other communicable and/or infectious diseases and the associated dangers, medical complications and physical and mental injuries, both foreseen and unforeseen, that may result from contracting COVID-19 or other communicable and/or infectious diseases.
If required, Winner and Guest, if any must cooperate with Sponsors' inquiries related to public health matters and follow Sponsors' related rules and processes, including, but not limited to, disclosures or processes recommended or required by public health authorities to protect the health and safety of Winner, Guest, and others. Winner and Guest may be subject to health screenings (which may include, but are not limited to, temperature checks, symptom screening, lab testing, and/or other medical exams) to be conducted by Sponsors, Prize Provider, or their designee(s) prior to or during the fulfillment of the Prize and related activities. Failure to fully comply with Sponsors' requests or requirements may result in forfeiture of the Prize or portions thereof, as determined in Sponsors' discretion.
During a period starting approximately four (4) weeks before participation in activities related to the Prize and ending approximately four (4) weeks after participation in the last of such activities (such period(s) subject to change based on medical guidance, and/or policy guidance), Winner and Guest may be required to inform Sponsors, upon Sponsors' request, about matters relating to communicable illnesses and safe fulfillment of the Prize and related activities, including, without limitation: (a) medical symptoms; (b) travel history; (c) recent contact with others who have displayed symptoms of or have otherwise been confirmed to have a communicable illness; and (d) active public health orders issued by a civil authority or any similar public health mandate (e.g., order to quarantine, order to stay at home, order to disclose communicable illness) to which Winner and/or Guest are subject.
EXCLUDING UNIVERSAL PRIZE CLAIMS, If THE controversy or claim is not otherwise resolved through direct discussions or mediation, it shall THEN be resolved by FINAL AND binding arbitration administered by JUDICIAL ARBITRATION AND MEDIATION SERVICES, INC., in accordance with its Streamlined Arbitration Rules and Procedures or subsequent versions thereof (“JAMS Rules”). The JAMS Rules for selection of an arbitrator shall be followed, except that the arbitrator shall be experienced and licensed to practice law in NEW YORK. All proceedings brought pursuant to this paragraph will be conducted in the County of NEW YORK, NEW YORK. THE REMEDY FOR ANY CLAIM SHALL BE LIMITED TO ACTUAL DAMAGES, AND IN NO EVENT SHALL ANY PARTY BE ENTITLED TO RECOVER PUNITIVE, EXEMPLARY, CONSEQUENTIAL, OR INCIDENTAL DAMAGES, INCLUDING ATTORNEY’S FEES OR OTHER SUCH RELATED COSTS OF BRINGING A CLAIM, OR TO RESCIND THIS AGREEMENT OR SEEK INJUNCTIVE OR ANY OTHER EQUITABLE RELIEF.
